City of Stewartville prevails against 300-unit manufactured home park expansion

Hoff Barry, P.A. Partner Justin L. Templin represented the City of Stewartville in a claim attacking the City’s denial of a 300-unit manufactured home park expansion the City viewed as too much, too fast.

In an order issued March 11, 2021 by Olmsted County District Court Judge Joseph F. Chase, the Court dismissed the claim against the City on a motion for summary judgment. The Court found that the City had leeway to decide not to rezone property to allow for the expansion, and that the Court would not step into the shoes of the City Council Members and dismiss concerns about overcrowded schools or the need for expending resources on additional law enforcement.
